Is operating a tractor on a farm classified as high-risk construction work requiring a SWMS?
Tractor operation itself is not listed as High-Risk Construction Work (HRCW) under WHS Regulation 2025 Schedule 3 unless performed on a construction site. However, Safe Work Australia and state regulators expect a SWMS or equivalent safe work procedure for tractor use because of well-documented rollover and PTO entanglement fatalities. The Managing the Risks of Plant Code of Practice requires documented risk assessment, operator competency and ROPS compliance under AS 2729, making a SWMS the practical compliance vehicle.
Do I need a separate SWMS for chemical spraying and livestock handling on the same property?
Yes. Each task presents distinct hazards, exposure pathways and control measures. Chemical spraying is regulated under WHS Regulation 2025 Part 7.1 with SDS, PPE and re-entry controls, while livestock handling involves struck-by, crush and zoonotic risks under the general duty in section 19 of the WHS Act. A combined SWMS often fails regulator review because controls cannot be mapped clearly to each activity. Separate SWMS make inductions, audits and incident investigations significantly cleaner.
What's the difference between a farm safety plan and a SWMS for agricultural work?
A farm safety plan is the property-wide WHS management system covering policy, training registers, chemical inventories and emergency arrangements. A SWMS is task-specific and documents the step-by-step hazards and controls for one activity — for example, chainsaw felling under the Managing Risks in Forestry Operations Code of Practice. Regulators expect both: the safety plan demonstrates systemic compliance with WHS Regulation 2025, while SWMS demonstrate operational control at the workface for each high-risk task.
Are quad bikes and side-by-side vehicles covered under agricultural SWMS requirements?
Yes. Following the ACCC Quad Bike Safety Standard and Safe Work Australia guidance, PCBUs must risk-assess quad and side-by-side use including operator protection devices (OPDs), helmets compliant with AS/NZS 1698, terrain, load limits and rider competency. A SWMS should document pre-start checks, prohibited terrain, passenger rules and the requirement that riders under 16 not operate adult-sized machines. This aligns with the Managing the Risks of Plant in the Workplace Code of Practice.
Do contractors and seasonal workers on my farm need to follow my SWMS or supply their own?
Under WHS Regulation 2025 section 46 (duty to consult, cooperate and coordinate), the PCBU engaging the contractor and the contractor both hold duties. In practice, contractors should supply their own SWMS for their specialist tasks — such as shearing, mustering by helicopter or silo cleaning — and the host PCBU reviews and aligns it with site rules. Seasonal workers performing your tasks follow your SWMS after a documented induction. Both approaches must be evidenced in writing.
