Frequently asked questions

Do I need a SWMS for residential lawn mowing and garden maintenance work?

A SWMS is legally mandated under WHS Regulation 2025 s291 only for High Risk Construction Work. Routine mowing and gardening generally fall outside HRCW, so a SWMS is not strictly required by law. However, most PCBUs still document the work in a SWMS or Safe Work Procedure to meet the broader risk management duty under WHS Reg 2025 s34-38, satisfy insurer expectations, and demonstrate consultation under the Model Code of Practice: How to Manage Work Health and Safety Risks.

Is tree pruning classified as high risk construction work in Australia?

Tree pruning becomes HRCW when there is a risk of a person falling more than 2 metres, per WHS Regulation 2025 s291(c). Pruning from ladders, EWPs, elevated platforms or the tree itself triggers the SWMS requirement, plus controls aligned to the Model Code of Practice: Managing the Risk of Falls at Workplaces. Ground-level pruning with pole saws is not HRCW but still requires documented controls for sharps, struck-by and overhead electrical clearance risks.

What licences are required to apply herbicides and pesticides commercially?

Commercial chemical application is regulated by state-based agvet authorities, with most jurisdictions requiring a Chemical User Licence or accredited training such as SMARTtrain or ChemCert. Under WHS Regulation 2025 Part 7.1, the PCBUs must maintain a hazardous chemicals register, current SDS, appropriate PPE per the SDS, and exposure controls. Application near waterways, schools or food crops carries additional notification duties under each state's Pesticide or Agvet Act.

What's the difference between a SWMS and a JSA for grounds maintenance?

A SWMS is a regulator-defined document under WHS Reg 2025 s299 that must list the HRCW, hazards, control measures and how controls are implemented, monitored and reviewed. A JSA (Job Safety Analysis) is an internal risk assessment tool with no prescribed format. For non-HRCW gardening tasks, either may suffice operationally, but principal contractors and government tenders usually require SWMS-format documents for consistency across all subcontractors on site.

Do ride-on mower operators need a licence or formal competency on commercial sites?

Ride-on mowers are not high risk work licence plant under WHS Reg 2025 Schedule 3, so no national licence applies. However, the PCBU must ensure operators are trained and competent under s39, typically via a verification of competency (VOC) or recognised unit such as AHCMOM213 Operate Tractors. The Model Code of Practice: Managing Risks of Plant in the Workplace also requires documented pre-start inspections and rollover risk controls on slopes exceeding manufacturer limits.
