Frequently asked questions

Do I need a SWMS for general landscaping work or only for high risk tasks?

A SWMS is legally required under WHS Regulation 2025 clause 299 only when work meets the High Risk Construction Work definition — for example, chainsaw use over 2 metres, powered mobile plant operation, or excavation deeper than 1.5 metres. Routine mowing or planting does not trigger the SWMS rule, but the PCBU still owes a duty under section 19 of the WHS Act to document risk controls. Most PCBUs prepare a SWMS or Safe Work Procedure for all landscaping tasks to demonstrate due diligence.

Is pest control classified as High Risk Construction Work in Australia?

Pest control itself is not automatically HRCW, but specific tasks within it are. Entry into roof voids, subfloors, or storage tanks triggers HRCW Category 11 (confined spaces) and requires compliance with AS 2865:2009 Confined Spaces. Application of Schedule 6 or 7 agricultural chemicals triggers HRCW Category 16 (hazardous chemicals) under WHS Regulation 2025 Chapter 7. A SWMS is required before these tasks commence, alongside a current Pest Management Technician licence in the relevant state or territory.

What is the difference between a SWMS and a JSA for general services work?

A Safe Work Method Statement (SWMS) is a legally prescribed document under WHS Regulation 2025 clause 299, mandatory for HRCW, and must name the high risk activity, hazards, controls, and how controls will be implemented and monitored. A Job Safety Analysis (JSA) is a broader risk assessment tool with no legal status — useful for non-HRCW tasks like routine HVAC filter changes or basic fencing repairs. Many general services PCBUs use JSAs for low-risk tasks and SWMS for HRCW to stay compliant without overdocumenting.
