Do I need a SWMS for commercial fit-out work or is a JSA enough?
A SWMS is legally required, not optional, whenever the work meets the High Risk Construction Work definition under Schedule 3 of the WHS Regulations 2025 β which most fit-out scopes do, through powered tools, work above 2 metres, or hazardous chemicals. A JSA is an internal hazard analysis tool with no legal status. The Construction Work Code of Practice requires the SWMS to be prepared before work starts, kept on site, and reviewed if conditions change or an incident occurs.
Is stone benchtop installation High Risk Construction Work under the 2025 regulations?
Yes. Post-fabrication stone benchtop installation triggers HRCW under Schedule 3 through powered tool use and residual crystalline silica exposure during on-site cutting, drilling or polishing. The engineered stone prohibition under WHS Regulation 2025 Part 7.1 bans fabrication but installation of pre-fabricated tops continues under strict controls. SWMS must address dust suppression, on-tool extraction to AS/NZS 60335.2.69, respiratory protection to AS/NZS 1716, and two-person manual handling for slabs typically exceeding 25 kg.
What controls are required for chlorine gas and acid dosing in pool plant rooms?
Pool chemical dosing falls under the Hazardous Chemicals Code of Practice and WHS Regulation 2025 Chapter 7. Required controls include segregated storage of acids and hypochlorites to prevent chlorine gas generation, mechanical ventilation, emergency eyewash and shower compliant with AS 4775:2007, gas detection where bulk chlorine is used, and a manifest if quantities exceed Schedule 11 thresholds. SWMS must cover decanting, line-breaking, emergency response and PPE including chemical splash suits and SCBA where applicable.
Do I need a state-specific SWMS for fit-out work in NSW, VIC or QLD?
Under the harmonised WHS framework, the core SWMS content is consistent across NSW, QLD, VIC, SA, WA, TAS, ACT and NT β all of which adopt the model WHS Regulations 2025 and Construction Work Code of Practice. State variations exist mainly in notification thresholds, licensing for specific trades, and regulator names. A well-structured SWMS template is jurisdiction-neutral provided it cites the model regulation clauses and is signed by workers on the specific site before work commences.
Who is responsible for the SWMS β the head contractor or the fit-out subcontractor?
Under WHS Regulation 2025 clause 299, the PCBU carrying out the High Risk Construction Work β typically the fit-out subcontractor β must prepare the SWMS. The principal contractor has a separate duty under clause 309 to obtain a copy before work starts and to ensure work is carried out in accordance with it. Both duties run concurrently. The Construction Work Code of Practice clarifies that consultation with workers performing the task is mandatory during SWMS preparation.
